Non-Commercial Flights

Non-Commercial operations with Complex motor-powered aircraft (NCC) are regulated by the European Commission.

Aircraft operators are subject to Annex III (Part-ORO) and Annex VI (Part-NCC) of commission regulation (EU) No. 965/2012.

The operator’s management system, operations manual and staff must correspond to the requirements established in Part-ORO and flight operations must be in concordance with Part-NCC. If an operator is applying for a special permit (e.g. RVSM, DG, MNPS, PBN), then they must correspond to the requirements established in Part-SPA.

Before initiating flight operations, the operator must submit a declaration to the competent authority of the member state that is their principle place of business or location.

Complex motor-powered aircraft

Airplane

  • Maximum certified takeoff mass over 5700 kg;
  • maximum certified passenger seating configuration over 19;
  • certified to fly with at least a two-pilot team;
  • one or more turbo-jet engines or more than one turbo-propeller engine.


Helicopter

  • ​​​​​​​Maximum certified takeoff mass over 3175 kg;
  • maximum certified passenger seating configuration over nine;
  • certified to fly with at least a two-pilot team.​​​​​​​

Non-commercial flight operations


Non-commercial flight operations are defined through commercial flight operations meaning that non-commercial flight operations are flight operations that are not commercial.

Commercial flight operations are any flight operations conducted with an aircraft for a fee or other form of compensation that:

  • ​​​​​​​are available to the public;
  • if not available to the public, are conducted based on a contract between a company and a client. In this case, the client must not have control over the company.

A template for the operations manual is available on the website of the European Union Aviation Safety Agency (EASA) which operators can use and adapt to the specifications of their flight operations.
