You have the right to claim compensation for damages if:
- The vehicle has been damaged due to driving through a pothole.
- The vehicle has been damaged due to other faults in the road surface that do not meet required standards.
Compensation is not paid for damages:
- that have not occurred on state roads;
- if the victim has violated the Road Traffic Act;
- if the sub-standard road conditions (potholes, loose crushed stone etc.) have been signposted with traffic control devices;
- that have been caused as a result of colliding with an animal;
- that have been caused by other vehicles.

Submitting a claim for damages
If your vehicle has been damaged, do the following at the scene of the accident:
- Stop and park safely. Turn on your hazard warning lights and ascertain the safety of yourself and others.
- Notify the police by calling 112 and the road information service by calling 1247.
- Record the incident with available means: write down the location, time, probable cause of the damage, extent of damages, etc. If possible, take pictures and write down the contact information of witnesses.
To submit a claim for damages, fill out the Road user’s claim for damages (EST).
Submit the claim electronically to the Estonian Transport Administration at maantee@transpordiamet.ee or in writing to Teelise 4, 10916 Tallinn.
